EAC Certification and EAC Declaration for Packaging is carried out in accordance with legal provisions and requirements of the Technical Regulations of the Eurasian Economic Union (TR CU /TR EEU).
The Technical Regulations of the Eurasian Economic Union establish unified requirements for the safety of packaging and packaging materials in the EEU Countries. The Technical Regulations also contain safety requirements regarding the production, composition and transportation of packaging.
The aim of the regulations is to establish unified safety requirements for packaging and packaging materials in the EEU countries as well as to protect the life and health of citizens in EEU States. An EAC Certificate or an EAC Declaration for packaging is a mandatory EAC Approval Document.
The EAC Certification for Packaging and Packaging Materials is carried out in accordance with the provisions of the Technical Regulations TR CU 005/2011. In the Technical Regulations TR CU 005/2011, the requirements for safety of packaging are stipulated in order to protect the life and health of citizens in the EEU Countries. According to the requirements of the Technical Regulations TR CU 005/2011 - On the Safety of Packaging, the packaging must be designed and manufactured in a safe manner, so that the risks arising from the design and composition are minimized when it is used as intended.
Furthermore, the provisions of the Technical Regulations TR CU 005/2011 - On the Safety of Packaging prescribe the EAC Labeling requirement. Compliance with minimum safety requirements of the Technical Regulations TR CU 005/2011 - On the Safety of Packaging is one of the conditions for access to the EAC market.
Furthermore, EAC Labeling is mandatory according to the regulations of the Technical Regulations TR CU 005/2011 - On the Safety of Packaging.
In order to comply with the provisions of the Technical Regulations TR ZU 005/2011, the packaging and packaging materials must be made of materials that are not harmful to health and must not pose a risk to consumers. In addition, the TR CU 005/2011 Technical Regulations set limits for the use of harmful substances and the EAC Label.
The provisions of TR CU 005/2011 are mandatory measures for all types of packaging, thereby the certification of EAC Conformity must be made according to the standards of TR CU 005/2011. In the requirements of the Technical Regulations TR CU 005/2011, EAC Declaration is mandatory for all packaging.
The packaging for tobacco products, dangerous goods, medicine, pharmaceutical products and medical products is not subject to the provisions of Technical Regulation TR CU 005/2011.
The EAC Certification of such packaging is carried out in accordance with other norms, standards or Technical Regulations, such as the Technical Regulations TR CU 035/2014 On the Safety of Tobacco Products or in the case of the registration of medical devices. The Technical Regulations TR CU 005/2011 - On the Safety of Packaging also concerns the packaging produced by manufacturers of other products.
Only the regulations on recycling and EAC Marking of packaging apply to this type of packaging. Such packaging does not require an EAC Declaration. All types of packaging are subject to the EAC Declaration obligation according to TR CU 005/2011 - On the Safety of Packaging.
The EAC Conformity Assessment of packaging is carried out exclusively in the form of EAC Declaration and is a mandatory measure for export to Russia and EEU States. EAC Certification is not provided for packaging and packaging materials.

Certified packaging is labelled with an EAC Marking. Thus, EAC Conformity with the Technical Regulations of the Eurasian Economic Union is confirmed. Placing packaging on the market without the appropriate EAC Marking is punishable by heavy fines and confiscation of the products.

The preparation time for the EAC Declaration for Packaging and Packaging Materials varies greatly depending on the type of product. According to the Eurasian Economic Union regulations, it is required that the manufacturer must have a registered office in the Common Economic Territory of the EEU States in order to apply for EAC Declaration. Thus, if the manufacturer does not have an establishment in the Eurasian Economic Union, a representative of the manufacturer is required to apply for and conduct the EAC Declaration processes in the Customs Union. Often the applicant is a distributor of the manufacturer from one of the states of the Eurasian Economic Union. It is necessary to take into account that afterwards only this distributor has an exclusive right of distribution for the certification period and must issue an authorization of sales activity for all other distributors.
In such situations, the manufacturer becomes dependent on his partner, who acted as the manufacturer's contract person during EAC Certification.
