EAC Approval for Tobacco Products in EAEU States

The EAC approval for cigarettes, tobacco, and tobacco products in the EAEU states is crucial for manufacturers and traders who wish to introduce their products into the EAEU market.

According to the Technical Regulation TR CU 035/2014 on the safety of tobacco products, all tobacco products must comply with the minimum safety requirements of the EAEU states.

EAC Conformity Assessment of Tobacco Products

The TR CU Directive 035/2014 of the EAEU states includes mandatory EAC safety requirements for cigarettes and tobacco products. The aim of the directive is to protect life, health, and the environment within the jurisdiction of the Eurasian Economic Union.

Furthermore, the measures of the TR CU Directive of the EAEU states aim to prevent misleading actions and information towards consumers and users.

The regulations of the TR CU Directive 035/2014 on the safety of tobacco and tobacco products ensure a uniform application for the marketing of cigarettes and tobacco products in the EAEU states.

The EAC conformity confirmation for cigarettes, tobacco, and tobacco products is carried out in accordance with the regulations of the TR CU Directive 035/2014 on the safety of tobacco and tobacco products, in the form of the EAC declaration for the EAEU member states.

EAC Marking of Cigarettes and Tobacco Products

The requirements of the TR CU 035/2014 Directive for the safety of tobacco products stipulate a corresponding EAC marking. The approved tobacco products must be marked with the EAC sign of the Eurasian Economic Union.

The EAC sign must be affixed to each packaging unit of tobacco products. The marking must remain visible and legible throughout the entire shelf life of the tobacco products. Additionally, all accompanying documents, such as data sheets or product information, must be marked with the EAC sign of the EAEU states.

Process of EAC Declaration of Tobacco Products

The declaration process is a method of EAC conformity assessment, in which the producer declares the EAC conformity of its products with the safety requirements of the TR CU Directives of the Eurasian Economic Union.

The declaration process includes the following steps:

1. Classification of tobacco products

2. Declaration of conformity of tobacco products

3. Preparation of an EAC declaration for tobacco products

5. Registration of the EAC declaration for tobacco products

It is important to note that the declaration process may vary for different tobacco products, depending on the type or category of the product.

The approval for cigarettes and tobacco products is carried out by the manufacturer or an authorized representative of the manufacturer (also referred to as the contracting person) and is subsequently registered in the unified online register of the EAEU member states.

Accompanying Documents for EAC Declaration

For the EAC declaration, different documents are required depending on the safety requirements of the Technical Regulations TR CU/EAEU.

The following documents are required for the declaration of tobacco products:

  • Detailed product description
  • Information about the manufacturer and importer
  • Existing certificates (CE, EAC, GOST, ISO)
  • Certificates for the quality management system
  • Customs tariff number

Depending on the tobacco product, additional documents or information may be required. All documents must be available in the official languages of the EAEU states.

The EAC declarations for tobacco products are equally recognized in all member states of the Eurasian Economic Union (EAEU).

Validity Period of the EAC Declaration for Tobacco

The EAC declaration is planned and carried out individually and always related to the product. The application for an EAC declaration for tobacco or tobacco products may take several weeks. The validity period of EAC declarations for tobacco and tobacco products is regulated differently.

In principle, a distinction is made between declarations for series production and single deliveries. The declaration for series production of tobacco products can be issued for a period of 1 to 5 years.

Various declaration schemes are applied for the declaration. The validity of declarations for tobacco and tobacco products according to schemes 1d and 3d is from 1 to 3 years, and the validity of declarations for tobacco and tobacco products according to schemes 5d and 6d is from 1 to 5 years. There are no fixed validity periods for the declaration of other tobacco products.

Costs of EAC Declaration for EAEU States

The costs of the EAC declaration for tobacco products depend on several factors:

  • Characteristics of tobacco products
  • Number of required product examinations
  • Complexity of required examinations
  • Number of required test protocols
  • Composition of products

Authorized Application for Tobacco Products

For the application and execution of the EAC declaration for tobacco and tobacco products in the states of the Eurasian Economic Union, an authorized representation of the manufacturer is required.

Thus, an authorized representation of the manufacturer is required in the EAEU member states. The authorized representative registers and manages the processes of the EAC declaration for tobacco products and represents the interests of the manufacturer.
